Commenting on Ruling STC9311-2024: Expected Support for Appeals of Rulings

Abstract
In the context of ordinary appeals, the appeal represents a means of challenge, providing the chance for a higher court to review potential first-instance errors. With the enactment of the 1991 Constitution, the guarantee of double instance has attained constitutional and even conventional significance.
This is an analysis of Ruling STC9311-2024, issued by the Supreme Court of Justice in its Civil Cassation Chamber, in which a tutela action is decided. In this ruling, the Court changes its position on procedural opportunity to support the appeal, denying prior support. This analysis evaluates the limited relevance of this judicial decision and offers constructive criticism, as it is deemed inconsistent with principles such as effective judicial protection and procedural economy.
